Topic: Conversations on Implicit Bias and its Implications on Law Firm Practice: From Clients to the Courtroom

This CLE is aimed to address implicit bias and its implications on the practice of law. We will discuss the ethical implications of understanding and confronting bias in decision making, how this understanding leads to better communication with clients, opposing counsel, and within the firm. Understanding bias leads to more effective client management and client service, leads to more awareness of firm needs and issues, and assists partners in understanding their role as leaders and mentors as well as decision-makers within the firm. We will address bright spots and pain points within the firm with an eye to addressing these areas with practical tools and takeaways.
The Goals for the Presentation:
Define and explain how Implicit Bias affects and guides our decisions.
To give a clear understating of how implicit biases are a barrier to a truly inclusive workplace/law firm. How Implicit Bias can affect routine decisions that can be barriers to an inclusive work environment.
Breakdown and recognize implicit biases. Once bias is addressed and broken down, there will be a better path towards inclusiveness in all spaces at the firm.
Once recognized, give the tools necessary to effectively manage through for the good of building culture of inclusion and diversity. This will take an ongoing commitment that we will ask from all attendees.
Though somewhat difficult to translate over paper, we strive for a cultural transformation around bias through our presentations. We are going deeper than just learning about Implicit Bias. This is intimate, individualized and creates lasting change in the core of each person attending. And because Mindy is an attorney and has worked in and for law firms, she understands the dynamics of firm life, client relationships, and the business of the practice of law.
About the Speaker:
Mindy Gulati is founder and CEO of Fundamental Advisory, a consulting firm focused on advising businesses, state and local governments, nonprofits, and law firms on issues related to Diversity, Equity, and Inclusion. Using her expertise and personal approach, she designs DEI strategic plans, drafts policies and procedures, and creates custom content and workshops for a wide range of organizations around the country. Her focus is strategy for equity & inclusion, implicit bias awareness, antiracism, creating innovative cultures, executive leadership coaching, educating on the ethical implications of bias, as well as guiding organizations on legal issues such as sexual harassment and discrimination. Her approach provides the foundational basis for cultural change through awareness, storytelling and understanding. She regularly tackles complex issues such as racial tensions at the workplace, implicit and explicit bias in decision making, creating culturally competent workplaces, compensation equity, and ethical leadership and management. Her legal background gives her a key advantage in understanding these issues with an eye towards risk mitigation and by crafting specific policies and procedures to guard against the harms that workplace inequities create.
